These Terms of Service ("Terms") are a binding agreement between you and TASSYIR LTD ("Tassyir", "we", "us", or "our"). They govern your access to and use of our website and merchant dashboard at app.tassyir.io and our "Tassyir" iOS mobile app (together, the "Service").

By creating an account, or by accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of a business, you confirm that you are authorised to bind that business to these Terms.

The Service is for merchants and businesses selling online. To use it, you must be at least 18 years old and able to enter into a binding contract. You may not use the Service if the law prohibits you from doing so.

Tassyir is an e-commerce platform that lets you create and manage online stores. Depending on your plan, features may include:

• Creating and customising one or more storefronts (multi-store)
• Managing products, prices, inventory and media
• Receiving and managing orders
• Organising deliveries and delivery-partner settings
• Managing your customers and order history
• Analytics and reporting on your store's performance

We may add, change or remove features over time. We provide the Service on both the web and the iOS app.

You are responsible for your account and everything that happens under it. You agree to:

• Accurate information: provide accurate, current and complete information and keep it up to date.
• Credential security: keep your password and login credentials confidential. You are responsible for all activity under your account.
• One account: you may not maintain multiple accounts to abuse the Service, and you may not share or transfer your account without our consent.
• Notify us: tell us promptly at [email protected] if you suspect any unauthorised use of your account.

Tassyir offers a free trial and paid subscription plans. The free trial lasts 7 days; when it ends, continued use of paid features requires an active paid subscription.

Paid subscriptions are managed and billed outside the iOS app — they are not purchased through the app. Prices, plan features and accepted payment methods are shown to you when you subscribe.

Unless required by law, fees are non-refundable. You are responsible for any taxes that apply to your use of the Service. We may change our prices or plans, and will give reasonable notice of changes that affect you.

You own the content and data you put into the Service — your stores, products, orders, and the customer information you collect ("Your Content"). We do not claim ownership of Your Content.

You grant Tassyir a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transmit and display Your Content solely as needed to operate and provide the Service to you (including backups, security and analytics to improve the Service). This licence ends when you delete the content or your account, except for copies retained as required by law or held in routine backups for a limited period.

You are responsible for Your Content and for how you collect and use your own customers' data. As between you and Tassyir, you are the controller of your customers' personal data and Tassyir acts as your processor; you must have a lawful basis to collect that data and to share it with us.

You agree not to, and not to allow anyone else to:

• Use the Service for any unlawful purpose, or to sell illegal or prohibited goods or services;
• Infringe the intellectual-property or privacy rights of others;
• Upload malware, or attempt to gain unauthorised access to the Service, other accounts or our systems;
• Reverse engineer, decompile or attempt to extract the source code of the Service, except where this restriction is prohibited by law;
• Scrape, crawl or use automated means to extract data from the Service, or copy or resell the Service;
• Interfere with, disrupt or place an unreasonable load on the Service or its infrastructure;
• Use the Service to send spam, or to harass, abuse or harm others;
• Misrepresent your identity or affiliation, or use the Service to deceive.

We may investigate and take action — including suspending or terminating accounts — for violations of these Terms.

You are solely responsible for your business and your stores, including:

• Complying with all laws that apply to your business, including consumer-protection, tax and e-commerce rules;
• The accuracy of your product information, pricing and availability;
• Fulfilling orders and handling deliveries, returns and customer service;
• Protecting your customers' data and giving them any privacy notices and rights required by law.

The Service relies on and integrates with third parties — including Apple, Google and Facebook (sign-in), PostHog (analytics), payment and delivery partners, and the app stores. Your use of those services may be subject to their own terms and policies. We are not responsible for third-party services, and their availability or behaviour is outside our control.

The Service — including its software, design, branding, logos and content (other than Your Content) — is owned by Tassyir or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms. You may not use our name or logos without our prior written permission.

If you send us feedback or suggestions, you grant us a perpetual, royalty-free licence to use them to improve the Service, without any obligation to you.

We work hard to keep the Service available and reliable, but we provide it on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free or secure, or that it will meet your requirements. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement.

To the fullest extent permitted by law, Tassyir will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or business, arising out of or relating to your use of the Service.

Our total liability for all claims relating to the Service in any 12-month period is limited to the greater of (a) the amount you paid us for the Service in that period, or (b) USD 100. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (such as liability for death or personal injury caused by negligence, or for fraud).

You agree to indemnify and hold harmless Tassyir and its officers, employees and agents from any claims, damages, losses and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, your products or business, or your breach of these Terms or of any law or the rights of others.

• By you: you may stop using the Service and delete your account at any time (in the app via Settings → Delete account, or by emailing [email protected]).
• By us: we may suspend or terminate your access if you breach these Terms, if required by law, or if your use poses a risk to the Service or others. Where reasonable, we will give you notice.

On termination, your right to use the Service ends. We will delete your personal data as described in our Privacy Policy, except where retention is required by law. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability and governing law) will survive.

We may modify the Service or these Terms from time to time. When we make material changes to these Terms, we will update the "Last updated" date and notify you through the Service, our website or by email. Your continued use of the Service after changes take effect means you accept the updated Terms; if you do not agree, stop using the Service.

These Terms, and any dispute arising out of or in connection with them or the Service, are governed by the laws of England and Wales, without regard to conflict-of-law rules. You and Tassyir agree to the exclusive jurisdiction of the courts of England and Wales, except that we may seek injunctive relief in any competent court. Nothing here removes any mandatory consumer-protection rights you may have under the law of your country of residence.

If you download or use our iOS app from the Apple App Store, you also agree that:

• These Terms are between you and Tassyir only, not with Apple, and Tassyir (not Apple) is solely responsible for the app and its content;
• Apple has no obligation to provide any maintenance or support for the app;
• To the extent required by law, Apple is not responsible for any product warranties or for addressing any claims relating to the app (such as product-liability, legal/regulatory or intellectual-property claims);
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you; and
• You confirm that you are not located in a country subject to a relevant U.S. embargo or designated as "terrorist-supporting", and that you are not on any U.S. government restricted-parties list.

You must also comply with any applicable third-party terms (such as the App Store Terms of Service) when using the app.

• Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and Tassyir regarding the Service.
• Severability: if any provision is found unenforceable, the rest remains in effect.
• No waiver: our failure to enforce a provision is not a waiver of it.
• Assignment: you may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
• Force majeure: we are not liable for delays or failures caused by events beyond our reasonable control.
